1. Acceptance of Terms

Welcome to RecipeSnap, a mobile application developed by Cardigan Studios ("we," "us," or "our"). By downloading, accessing, or using RecipeSnap (the "App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting within the App. Your continued use of the App after any modifications constitutes acceptance of the updated Terms.

2. Description of Service

RecipeSnap is a mobile application that allows users to:

• Scan and digitize recipes from photos using AI-powered text extraction
• Import recipes from web URLs
• Organize and manage personal recipe collections
• Store recipe data locally on their device

The App offers both free and premium subscription tiers with different usage limits and features.

3. Subscription Terms

3.1 Free Tier

Free users may scan or import up to 3 recipes. No account creation is required.

3.2 Premium Subscription

Premium subscription options include:

• Weekly: $7.99 USD per week with a 3-day free trial
• Annual: $24.99 USD per year with no trial period

3.3 Billing and Cancellation

• Subscriptions are processed through the Apple App Store or Google Play Store
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Cancellation can be managed through your device's subscription settings
• Refunds are handled according to Apple App Store and Google Play Store policies
• Upon cancellation, you retain access to previously scanned recipes but cannot scan new ones

4. User Responsibilities and Restrictions

4.1 Permitted Use

• You may only scan recipes that you own or have explicit permission to digitize
• Scanned recipes are for personal use only
• You must have a compatible device with camera functionality to use scanning features

4.2 Prohibited Use

You agree not to:

• Scan copyrighted material without permission from the copyright holder
• Use the App for any commercial purposes
• Share or distribute recipes scanned through the App
• Attempt to reverse engineer, modify, or create derivative works of the App
• Use the App for any illegal or harmful purposes
• Interfere with or disrupt the App's functionality
• Violate any applicable laws or regulations

4.3 Enforcement

Violation of these Terms may result in immediate restriction of your access to the App's conversion features through IP-based limitations. We reserve the right to take appropriate action for any violations.

5. Intellectual Property

5.1 App Ownership

RecipeSnap and all related intellectual property rights belong to Cardigan Studios. This includes the App's code, design, features, and functionality.

5.2 User Content

You retain full ownership of any recipes you scan or import. We do not claim any ownership rights over your recipe content. You are solely responsible for ensuring you have the right to scan and store any recipes.

5.3 License to Use

We grant you a limited, non-exclusive, non-transferable license to use RecipeSnap for personal purposes in accordance with these Terms.

6. Data and Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information. All recipe data and images are stored locally on your device and are not permanently stored on our servers.

7. Disclaimers and Warranties

7.1 "As-Is" Basis

RecipeSnap is provided on an "as-is" and "as-available" basis. We make no warranties, express or implied, regarding the App's functionality, reliability, or accuracy.

7.2 No Warranty

We disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the App will be error-free or uninterrupted.

7.3 Scanning Accuracy

While we strive for accuracy in our AI-powered text extraction, we cannot guarantee perfect results. Users should review and verify all scanned content for accuracy.

8. Limitation of Liability

To the maximum extent permitted by law, Cardigan Studios shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or relating to your use of RecipeSnap.

Our total liability for any claims arising from or relating to the App shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Cardigan Studios from any claims, damages, or expenses arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

10. App Updates and Modifications

We reserve the right to modify, update, or discontinue RecipeSnap or any of its features at any time without notice. Updates will be distributed through the Apple App Store and Google Play Store.

We may also modify subscription pricing or features with reasonable notice to users.

11. Third-Party Services

RecipeSnap integrates with third-party services for functionality including payment processing (RevenueCat), analytics (PostHog), text recognition (Google Vision), and AI processing (OpenAI). Your use of these services is subject to their respective terms of service and privacy policies.

12. Termination

These Terms remain in effect until terminated. We may terminate your access to the App at any time for violation of these Terms. You may stop using the App at any time.

Upon termination, your right to use the App ceases immediately, but locally stored recipe data on your device will remain accessible.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms or your use of RecipeSnap shall be resolved in the courts of New South Wales, Australia.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
